no there is a check before this that checks if it is full

I'll test it. It'll be a little while for me to compile the core since I recently rolled the VM back to it's clean snapshot.

Maybe I can do some looking too if that fixes it, see if there's a way of fixing the +1 thing. I doubt I'll be able to figure it out if you can't but still doesn't hurt with two sets of eyes.
