has anyone worked with FilterTarget hook in spells which prefers given targets that do not have a certain aura on them BUT if after filtering them the size of the targets is lower than the actual MaxTarget of the spell, it fills it with the ones that have the buff randomly?

yeah. just create a copy of the targets and filter that one. if the size of the copied targets is lower than what you want, just resize the original targets, otherwise assign the copy
