Terms of service and EULAs are often not enforceable, many arguments why including that it's too long or too much jargon to be comprehended by the average user.
UK is part of Europe but not the EU, and still inherits most EU laws. Terms are interchangeable for the most part

On this though, if the end user was never presented with the eula, then they can't have accepted it nor is it reasonable to assume that the user even knew such an eula existed and actively circumvented it. I'm not saying the end user actively went into the config file and disabled the option prior to starting the game, I'm saying the option by default, as provided by most download sources, has this already disabled. Whether it's legally binding or not isn't for me to speculate on, but common sense dictates that you can't agree to something you don't even know exists.
