It's kind of a guesstimate and checks the more typical nodes that a spec usually has, there's no way to determine a spec in any other way in 3.3.5

couldn't I just calc all taken talents per talent tree and just determine the spec by which tree has the most talents?

Sure but that wouldn't be 100% either, and you'd have to write an equivalent function that the client uses to determine that icon

There are pvp tank specs as an example that uses more points in ret/holy than in prot ‍♂️
