Both. Context is always required to determine these things. Attempting to apply a blanket statement or judgement without context is just an excuse to be lazy and not take all facts into consideration.

Because e.g. I can easily claim that it is impossible to survive in some places for people who are paying for legal movies, legal games, legal Microsoft Windows, legal Adobe software and whatnot.

If we are to talk ethics a custom server is a blessed thing to do for all the people who wish to play things wow doesn’t have. Have some donations to cover the server costs and development, if you don’t really make profit what’s the sin in that.
